Terms and Conditions
In
the terms and conditions below Brigitta (UK) Ltd T/A Fantastic
Houses will be referred as the company, the client with be the
person whom signs the contract acceptance form, from this point
in this document. Any adjudication service between the company
and the client will be referred as the independent third party.
The signed agreement between the company and the client will
be known as the contract.
Design
Service:
1. The design and quotation service is free of charge within
location of Oxfordshire and borders area of Oxfordshire and
any other areas at the discretion of the company.
1a. No plans will be left or given to the client until payment
is paid and the company retains the full copyright to the plans.
1.b The order is placed when the contract acceptance is signed
by both the company and the client
Payments:
2a. A deposit of £100 is to be paid at the time of the
contract acceptance form.
2b.The outstanding balance of the product total order value
must be received a minimum of 7 full working days before the
delivery of the order. Any delay in this payment will result
in a delay of delivering your products. If as a result the installation
company charge a lay charge of £150.00 per day will be
levied. The company will not be held responsible for any charges
due to a delay in receiving the final balance.
2c. The installation fee will be payable direct to the fitters,
either weekly (amount due is the weekly sum earned) on a Friday
or on completion of the fitters work, which ever is sooner.
Any outstanding balance of the installation charge is payable
upon completion and is payable direct to the Installer.
2.dThe project management fee is payable on signing the contract.
Disputes
or claims for compensation:
3. Any disputes regarding any units, appliances and/or installation
of the units/appliances, will be referred to the manufacturer
or installer.
4. Any dispute or claim for compensation must be made in writing
to the company and will be referred to an independent third
party for adjudication.
5. The third party will be an independent party such as Qualitas,
a surveyor, manufacturer or equivalent or any person stated
by the company.
6. Any substandard products that the independent party declares
is not up to a standard that they hold within reasonable standard,
will be replaced free of charge with no compensation being paid
to the client.
7. The independent third party will set any level of compensation
to be paid by the company, which will be paid by the company
within 30 days of the independent third party decision.
8. Should the independent third party find in favour of the
company, the cost of the independent third party is to be borne
by the client.
Delivery:
9. The company will do all that it reasonable to meet the date
given for delivery. In the case of unforeseen circumstances
beyond the reasonable control of the company, the company may
not be able to do so. In such circumstances the company will
contact the client and agree an alternative date and no compensation
will be payable by the company.
10. The client will also do all that he/she reasonably can to
enable delivery and/or installation to take place on the given
date. In the case of unforeseen circumstances beyond reasonably
control of the client, the client may not be able to do so.
In such circumstances the client will contact the company and
agree an alternative date within a reasonable time period.
11. On delivery or collection, the risk of any loss or damage
to the goods delivered becomes that of the client. Clients are
advised to check all goods and advise the company within 3 working
days of any faulty goods. Good will not be placed into the clients
house by the delivery company over the threshold of the dwelling,
but the delivery company will place goods in the garage as long
as there is unobstructed space in the garage. The delivery company
will not accept any liability for damage unless neglect can
be proven. The client must be present at time of delivery to
assist the delivery driver, and the company will entertain no
acceptance of injury or damage should the client injury themselves,
the company expects the client to be in a fit and healthy condition
to accept and assist in the delivery of goods to fulfil this
agreement. Should the client require assistance for the delivery,
the company will supply a person for the fee of £50.00
plus VAT.
Installation:
12. The company does not install any of it's products, but will
engage an installer on your behalf as part of it’s project
management service and by doing so will do all that it can to
assist the installer in the completion of the project.
13. Any dispute between the installer and the client, is between
the two parties although the company will do all that it can
to remedy the cause for compliant, but no responsibility about
the cause of dispute with be borne by the company unless it
can be proven that the company was at fault.
General
conditions
14. For all goods supplied the manufactures warrantee’s
will apply.
15. Nothing in this contract confers or purports to confer on
any third party any benefit or any rights to enforce any terms
of this contract.
16. It is acknowledged by the client that the colour of natural
wood products may fade or discolour overtime due to natural
processes and the company accepts no responsibility for such
occurrence.
17. The client will legally own the goods ordered and delivery
of all goods will be guaranteed in this contract upon a cleared
payment in full..
18. Although the company may be prepared to agree to certain
changes to the original terms of the contract, this will be
on the understanding that it does not infringe the companies
full rights under the contract and that it does not prevent
the company from exercising those rights in the future.
19. The company will not be held responsible for any work, goods,
installation and anything not specifically mentioned in the
contract.
20. This contract does not affect your statutory rights.
21. Unless this contact is signed by all parties the company
accepts no responsibility for any goods supplied.
22. The company's web site is the main place to view it's terms
and conditions, it is also it's main area of retail and has
done all it can to fulfil all the legal requirements laid upon
it, should you notice any errors please bring them to the attention
of the company.
Project
Management:
23. If the company is employed in the field of project management,
the company will act on the clients behalf concerning all aspects
of the project management of the contract and will do all it
can to remedy any such problems that arise, the company cannot
be held responsible for any problems that cannot be resolved
due to factors beyond the control of the company.
Cancellation of this agreement
24. Should the client wish to cancel the order placed under
these terms and conditions, the company claims the right to
charge the client the full amount or any costs incurred by the
company.
